Terms of Service

These Terms of Service (the Terms) govern your use of the website and services of The Mountain Butler, LLC (we, us, or our). By placing an order or using our service, you agree to these Terms.

Our service

The Mountain Butler provides a pre-arrival grocery and lifestyle concierge service for vacation rentals in and around Pagosa Springs, Colorado. You send us your shopping list and arrival details, a local shopper purchases the items from area stores, and we deliver and put them away before your arrival.

Placing an order

When you place an order, you authorize us to shop on your behalf and to purchase the items you request, along with reasonable substitutions where you have allowed them. You agree to provide accurate and complete information, including your arrival date, delivery address, and any access instructions.

Pricing and fees

You pay the actual cost of your groceries plus a service fee of 35% and a delivery fee of $49.00. Because grocery prices and availability vary, the final total may differ from any estimate. The rates on this page are the rates that apply to your order; they may change over time, and the amounts in force when you place your order are the ones you agreed to.

Minimum order. We operate a minimum grocery order of $150.00. If your groceries come to less than the minimum, your order is billed at the minimum — the difference appears as a separate line on your receipt, and the service fee and any tip are calculated on the minimum rather than on the smaller grocery total. This is because the cost of shopping for and delivering an order is largely the same whatever its size.

Deliveries further out. Deliveries within 5 miles of the store carry no extra charge. Beyond that, a surcharge of $5.00 per additional mile applies, counted in both directions — out to you and back — since the drive is made twice. This surcharge is capped at $250.00, however far the delivery. Distance is measured along the driving route from the store; if a route cannot be calculated we use the straight-line distance instead, which is shorter. Where a surcharge applies it is calculated from your delivery address and forms part of the total you agree to when you place your order — it is never added afterwards. If we cannot pinpoint your exact address, no surcharge is applied.

Rush orders. Orders placed close to your arrival time carry a rush fee, which increases the nearer the order is to delivery. The amount that applies to your order is shown on your receipt.

Payment and authorization

When you check out, we place a small authorization hold on your payment method. Because the exact grocery total is not known until shopping is complete, your card is charged for the final amount, including groceries, service fee, delivery, and any tip, after your order has been delivered.

Substitutions and availability

If an item is unavailable, we will follow your substitution preference for that order. We cannot guarantee that every item will be in stock, and we are not responsible for items that are unavailable at area stores.

Alcohol

We can include beer, wine, and spirits with your order where permitted. A person who is 21 or older with a valid government-issued photo ID must be present to receive any order that includes alcohol. We may refuse to deliver alcohol if a valid ID is not presented.

Changes and cancellations

You may change or cancel your order up to 72 hours before your arrival at no charge. After that time we may have already begun shopping, and changes or cancellations may incur a charge. Please contact us as soon as possible and we will do our best to help.

Delivery and access

You are responsible for providing accurate delivery and access information. We are not responsible for delays or problems caused by inaccurate information, or for conditions at the property that are outside our control.

Tips

Tips are optional and always appreciated. One hundred percent of any tip goes to the shopper who handled your order.

Allergies and dietary needs

We are not able to guarantee that any item is free from particular allergens or suitable for a specific diet. Please review product packaging and labels carefully before use.

Disclaimers

Our service and website are provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied.

Limitation of liability

To the fullest extent permitted by law, the total liability of The Mountain Butler arising out of or relating to your order or these Terms will not exceed the amount you paid for the order in question. We will not be liable for indirect, incidental, or consequential damages.

Text messages

If you tick the box on our checkout or partner sign-up form, we may text you about your order or about deliveries to your properties — the delivery window, a question when something on your list is out of stock, and a note when we are done. These come from a real person, not an automated marketing system, and we do not send promotions by text.

Expect a few messages per order. Message and data rates may apply, depending on your mobile plan. Agreeing is never a condition of placing an order or becoming a partner — every notification we send by text, we also send by email, so you lose nothing by declining.

Reply STOP to any message to stop them, at any time, at no cost. Reply HELP for help, or contact us on the details below. We never sell or share your mobile number, and we do not text numbers we obtained from anywhere other than you.

Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. Any dispute will be handled in the state or federal courts located in Colorado.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page, and your continued use of our service means you accept the updated Terms.
